## 1. Acceptance of these Terms
By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
We may update these Terms from time to time. The version displayed on the Website at the time you use it will apply.
## 2. About The Level-Up Club
The Level-Up Club provides information about its community, events, retreats, networking opportunities, founder stories and related activities for ambitious women. Website content is provided for general information and inspiration only. It is not business, financial, legal, tax, health, medical or other professional advice, and you should obtain advice appropriate to your circumstances before relying on it.
## 3. Website access and acceptable use
You may use the Website for lawful, personal and non-commercial purposes. You must not:
- use the Website in a way that breaches any law or infringes anyone else’s rights;
- interfere with, damage, disable or disrupt the Website, its security or any network connected to it;
- introduce viruses, malware or other harmful material;
- scrape, copy, reproduce, distribute or exploit Website content except as permitted by law or with our prior written permission;
- use our name, branding or content in a way that suggests endorsement or affiliation without permission; or
- submit false, misleading, offensive, unlawful or infringing material through the Website.
We may suspend or restrict access to the Website if we reasonably believe these Terms have been breached or where necessary for security, maintenance or legal reasons.
## 4. Intellectual property
Unless otherwise stated, we or our licensors own the intellectual-property rights in the Website and its contents, including its branding, text, graphics, photos, videos, design and event materials. All rights are reserved.
You may view and print reasonable extracts for your own personal use. You must not use, reproduce, modify, publish, sell, license or commercially exploit any content without our prior written permission, except where a legal exception applies.
Third-party names, logos, images and materials remain the property of their respective owners. Their appearance on the Website does not grant you any rights in them.
## 5. User submissions and Founder Spotlights
If you send us a message, suggestion, testimonial, image, biography, business information or other material ("Submission"), you confirm that:
- it is accurate to the best of your knowledge;
- you own it or have all permissions needed to provide it to us;
- our use of it as agreed with you will not infringe another person’s rights or break the law; and
- it does not contain unlawful, defamatory, abusive, discriminatory or otherwise inappropriate material.
Unless we separately agree otherwise in writing, you retain ownership of your Submission. By submitting it for a Founder Spotlight, testimonial, social post, event feature or collaboration, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit for length or format, publish and share it for the agreed feature and reasonable promotion of The Level-Up Club, including through our Website, newsletter and social-media channels. We will not materially alter the meaning of a personal story without reasonable cause.
You can ask us to stop future use of a Submission by contacting hello@thelevelupclub.uk. This will not normally require us to remove material already printed, already scheduled, or already reposted by third parties, but we will consider reasonable requests promptly.
## 6. Events, retreats and bookings
Where we offer tickets, places, retreats or other paid services, the relevant booking page, checkout process or written confirmation may set out additional terms, including price, payment, cancellation, transfer, age, conduct, venue, accessibility, dietary and health-and-safety requirements. Those additional terms form part of the agreement for that booking. If there is a conflict, the event-specific terms will take priority.
Event programmes, speakers, venues, timings and inclusions may change where reasonably necessary, including for safety, operational or circumstances outside our control. We will use reasonable efforts to notify affected attendees of material changes.
You are responsible for ensuring that any information you provide for a booking is accurate and that you meet any stated entry, age, health, safety or venue requirements. You must behave respectfully towards attendees, staff, speakers, venues and suppliers. We may refuse entry or require a person to leave where their conduct is unsafe, disruptive, abusive, discriminatory, illegal or materially breaches event rules. This does not affect any rights you may have under consumer law.
Event photography or filming may occur. Please see our Privacy Policy and any event notice for details and how to raise a concern.
Nothing in these Terms removes or limits statutory rights that cannot lawfully be excluded, including relevant consumer rights.
## 7. Third-party links and collaborators
The Website may link to third-party websites, social-media platforms, venues, speakers, sponsors, suppliers or collaborators. These links are provided for convenience and do not mean we endorse or control those third parties. We are not responsible for their content, availability, products, services, terms, privacy practices or actions. Any dealings with a third party are between you and that third party.
## 8. Website availability and accuracy
We aim to keep the Website accurate and available, but we do not guarantee that it will always be uninterrupted, error-free, secure or up to date. Content may change without notice. To the extent permitted by law, the Website is provided on an "as is" and "as available" basis.
## 9. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.
Subject to the preceding paragraph, and to the extent permitted by law, we will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill, loss of data, or loss arising from your inability to access or use the Website. Nothing in this section affects your statutory consumer rights.
## 10. Privacy
Our use of personal information is explained in our Privacy Policy, which forms part of these Terms.
## 11. Governing law and jurisdiction
These Terms and any dispute or claim arising from them are governed by the law of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in another jurisdiction.
